A 38-year-old man from Kezi in Matebeleland South province escaped jail for assaulting a fellow villager over some missing dried meat after he was sentenced to do community service.
Kezi senior resident magistrate, Busani Sibanda, convicted Kholwani Ndlovu after finding him guilty of assaulting Polani Ngwenya from Donkwe Donkwe village using clenched fists.
Ndlovu was sentenced to 15 months in prison, but Sibanda suspended five months for five years on condition that he does not commit a similar offence.
The remaining 10 months of his sentence were wholly suspended on condition that he performs 350 hours of community service at the Kezi magistrates Court.
Prosecutor Godfrey Ziki said on November 3 last year at around 10pm at Esibayeni slaughter house in Kezi, the convict had a misunderstanding with the complainant over some missing dried meat.
The misunderstanding turned physical as the convict assaulted the complainant with clenched fists.
Ngwenya managed to escape, and went to file a police report leading to Ndlovu’s arrest.
A medical affidavit detailing the injuries Ndlovu sustained was presented in court as evidence.
