Farmer acquitted of assaulting widow

According to a judgment produced by the Marondera Magistrates Courts, the evidence provided in court was not sufficient to nail Saunders

A MACHEKE farmer, Charles Lee Saunders, who appeared in court facing a charge of assaulting a widow, was recently cleared of the charge.

Saunders was dragged to court by Maivepi Jiti, who claimed that she was assaulted at Yardford Farm in Macheke and sustained injuries.

The parties are embroiled in a bitter wrangle of ownership of the farm.

According to a judgment produced by the Marondera Magistrates Courts, the evidence provided in court was not sufficient to nail Saunders.

“It has been established that in all criminal matters, where there is doubt that an accused person committed an offence such doubt should be resolved in favour of the accused person. In the result, the accused person is hereby found not guilty and acquitted,” the judgment read.

According to the court papers, on March 27 this year at around 6pm, Saunders assaulted Jiti after the latter had switched power off from the switch room at the farm.

A misunderstanding arose between the two, resulting in a scuffle.
