Illegal billboard erectors apply for refusal of further remand

Their lawyer Tendai Biti notified magistrate Yeukai Dzuda that he will file an application for removal from remand.

Two Harare company directors accused of erecting an illegal billboard in Borrowdale discrediting a property developer have filed a notice to apply for refusal of further remand.

Grant Russel, a director of Fairclot, and Mark Strathen of Paragon Printing are facing criminal nuisance charges.

Their lawyer Tendai Biti notified magistrate Yeukai Dzuda that he will file an application for removal from remand.

The State represented by Shambadzeni Fungura will respond after receiving the application.

The duo is challenging a High Court order to proceed to trial.

It filed its application for exception at the lower court saying the charges were defective.

However, then Harare magistrate  Shane Kubonera dismissed their application saying they raised triable issues.

Aggrieved by the dismissal of their application, they approached the High Court for review, but the upper court also ordered them to proceed to trial.

It is the State’s case that on December 10, 2020 at around 2pm directly opposite Celebration Church in Borrowdale, Harare, the accused persons erected a billboard with damaging information about West Properties.

The State alleges that the billboard had contents which were likely to interfere with the ordinary comfort or convenience of the complainant’s clients.

The complainant made a report to the police, leading to the pair’s arrest.
