Man kills ‘attacker’, faces murder charge

Prosecutor Thomas Chanakira alleges that on July 3 this year, Kagondo was on his way home in Retreat Waterfalls, Harare, from his mother’s place of residence located in the same neighbourhood.

A HARARE man is facing a murder charge after he allegedly resorted to deadly force to protect himself from assailants, leading to the fatal injury of one of the attackers.

Harare magistrate Apollonia Marutya yesterday remanded Kelvin Kagondo (34) in custody to July 22 this year and advised him to approach the High Court for bail application.

Prosecutor Thomas Chanakira alleges that on July 3 this year, Kagondo was on his way home in Retreat Waterfalls, Harare, from his mother’s place of residence located in the same neighbourhood.

Chanakira said Kagondo was carrying two children's bicycles, a pram, a guitar and a small bucket with 60 boiled eggs.

He told the court that the now deceased and other  patrons, who were drinking at a local beer  outlet, confronted Kagondo demanding to know where he got the items from.

The now deceased and his accomplices then reportedly took turns to assault Kagondo while accusing him of stealing the property and demanding a confession.

The court heard that, amid the chaos, Kagondo picked a quarter brick and threw it towards the assailants in retaliation, hitting one of the men on the head who fell and became unconscious.

Kagondo allegedly fled from the scene.

Chanakira told the court that the now deceased was taken to Sally Mugabe Central Hospital where he was pronounced dead on arrival.

During investigations, Kagondo allegedly led to the recovery of his blood-stained shirt at his place.

Police also recovered the blood-stained brick used in the alleged murder.
